Terms of Service

1. Acceptance of Terms

By accessing or using the theFlock platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, do not use the Service.

2. Description of Service

theFlock is a church management Software-as-a-Service (SaaS) platform providing integrated tools for member management, financial administration, event planning, communications, and ministry operations. Features are described at theflock.company/features and may be updated from time to time.

3. User Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information when registering and keep it up to date.

You must notify us immediately at help@theflock.company of any unauthorised access or suspected breach. We are not liable for losses arising from failure to keep credentials secure.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law
  • Transmit harmful, offensive, or misleading content
  • Attempt to gain unauthorised access to any part of the Service
  • Reverse engineer, decompile, or extract source code
  • Resell or sublicense the Service without written permission
  • Use automated tools to scrape or extract data beyond normal platform use

5. Data Ownership

Your data is yours. All congregation member data, financial records, documents, and content you input into the platform remain the property of your organisation. theFlock acts solely as a data processor on your behalf.

You may export your data at any time through the Admin console. Upon termination, we will provide a data export and delete your data within 90 days as described in our Privacy Policy.

6. Payment Terms

Subscription fees are billed monthly or annually in advance. All fees are non-refundable except as required by law or stated in our refund policy. We reserve the right to change pricing with 30 days' notice to existing subscribers.

Failure to pay may result in suspension of access. We will provide at least 7 days' notice before suspension for non-payment.

7. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for downtime outside our reasonable control including infrastructure failures, natural disasters, or third-party service outages.

8. Limitation of Liability

To the fullest extent permitted by law, theFlock shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or goodwill. Our total liability for any claim relating to the Service shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Termination

You may cancel your subscription at any time from the Settings page. Your access will continue until the end of the current billing period.

We may suspend or terminate your access for material breach of these Terms with notice where practical. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
